Where Will My Meeting of Creditors Be Held if I Filed Bankruptcy in Fremont?

Fremont Oakland Bankruptcy Meeting of CreditorsIf you live in Fremont or any other city in Alameda or Contra Costa counties and have filed bankruptcy, then your bankruptcy petition was filed in the Oakland Division of the US Bankruptcy Court, Northern District of California. All Meetings of Creditors required under section 341 of the Bankruptcy Code are held at the Ronald V. Dellums federal building in downtown Oakland at 1301 Clay Street, Room 680N, which is located in the North Tower. There is a parking garage directly across Jefferson Street from the federal building. Everyone entering the building must present valid photo identification and submit to airport style security screening. At your meeting, the bankruptcy trustee will also require that you present proof of your social security number.

As a bankruptcy attorney serving Fremont Chapter 7 and Chapter 13 bankruptcy clients, I regularly appear at meetings of creditors in Oakland, and as with all other Bay Area bankruptcy debtors, these 341 meetings cause a good deal of anxiety for our clients. But they needn’t. We make it standard practice to always meet with our Fremont bankruptcy clients in advance of the meeting of creditors in order to put our clients at ease about this meeting. As I tell everyone of our clients, the honest bankruptcy debtor has absolutely nothing to fear about this meeting. As long as you have truthfully disclosed all of your income, expenses, and assets, as well as any transfers of assets, then you have nothing to worry about at this meeting.

Creditors themselves rarely appear at these meetings despite the fact that it is called a “Meeting of Creditors.” Instead the meeting is generally attended by just the debtor, the bankruptcy lawyer, and the Chapter 7 or Chapter 13 bankruptcy trustee.
